Terms of Use

These Terms of Use ("Terms") govern your access to and use of Swoopr Investment at getswoopr.com, including its public educational content, research resources, market-information features and tools, and any authenticated product capabilities made available to approved users (collectively, the "Service"), except where a separate agreement expressly applies. By browsing the public site, creating a session, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Swoopr Investment Is

Swoopr Investment provides general educational, informational and research resources related to investing, financial markets and trading. Public resources may include articles, glossary content, learning paths, market information, calculators, simulators, scorecards, comparison tools and related features. These are open to anyone and do not require an account.

Swoopr Investment separately makes authenticated dashboard functionality available to approved users. Dashboard features, third-party integrations and access conditions may differ from the public platform and may change over time. The Swoopr Investment Dashboard is invite-only; once you're granted access, it lets you:

Swoopr Investment does not itself execute trades, hold custody of funds or securities, extend credit, or act as a bank, broker-dealer, or payment processor. Any order execution happens on the third-party trading platform you connect, under that platform's own terms.

Portions of the public Service's tools and educational content are made available for use by AI assistants and browser agents acting on a user's behalf, through a structured interface described at AGENTS.md. Use of these interfaces by an agent on your behalf is treated as your own use of the Service, and you remain responsible for actions taken through them. These interfaces are read-only and calculation-only unless otherwise stated for a specific tool; none of them place trades, move funds, or access your Dashboard credentials.

2. Eligibility and Account Access

The public educational content, tools, and calculators are open to anyone regardless of age and require no account, subject to any age requirements imposed by law in your jurisdiction. Access to the Swoopr Investment Dashboard, which requires an invite and a Google account, is limited to users who are at least 18 years old, able to form a binding contract, and legally permitted to use the Service in their jurisdiction. You're responsible for maintaining the security of the Google account used to sign in and for all activity that occurs under your session.

3. Your Responsibilities

You agree to provide accurate information when connecting a third-party trading platform, to keep any credentials you enter confidential, to use the Service only for lawful purposes, and not to attempt to probe, scan, or bypass its authentication or access controls (this does not include use of the Service's published public tools or AI-agent interfaces as documented). You are solely responsible for the trading decisions you make, whether informed by data shown in the Service or not.

4. No Investment Advice

Swoopr Investment is an independent investment education, research, and tools platform, not an investment adviser, broker-dealer, or fiduciary. Nothing in the Service, including price data, sparklines, sentiment gauges, risk scores, rebalance previews, rankings, or AI-generated summaries, constitutes investment, legal, accounting, or tax advice, or a recommendation or solicitation to buy, sell, hold, short, stake, lend, or otherwise transact in any asset. No use of the Service creates any fiduciary, advisory, brokerage, agency, or client relationship. Trading involves risk, including the risk of loss, and you should independently evaluate any decision before acting on it. 5. No Reliance

You acknowledge that any decision to buy, sell, hold, or otherwise act on an asset is made independently by you, based on your own evaluation, and not in reliance on anything shown in the Service. Rankings, scores, and AI-generated content reflect a defined, disclosed methodology applied mechanically to available data, see our Data & Methodology Disclosure: and do not account for your personal financial circumstances.

6. Third-Party Services, Data, and APIs

The Service displays market data sourced from third-party providers and, in places, content generated by a third-party AI provider (see our AI-Assisted Content Disclosure for how we use AI in producing and maintaining educational content), accessed through their respective APIs. That data and content may be delayed, incomplete, inaccurate, or temporarily unavailable, and Swoopr Investment does not guarantee its timeliness, correctness, or availability, and disclaims liability for it to the fullest extent permitted by law. Your use of any connected third-party trading platform remains subject to that platform's own terms and policies, which we do not control.

7. Intellectual Property

The Service's design, code, and branding, including the Swoopr Investment name and "Investment Education, Research & Tools for Smarter Decisions." tagline, belong to Swoopr Investment or its licensors. You may not copy, modify, or redistribute any part of the Service outside of ordinary, permitted use of your own account.

8. Prohibited Conduct

You agree not to: interfere with or disrupt the Service or its infrastructure; attempt to access another user's account or data; scrape or bulk-extract data beyond ordinary personal use (this does not include use of the Service's published AI-agent tool interfaces in the manner they are documented to support); reverse engineer the Service except as permitted by law; attempt to manipulate any ranking, score, or screen produced by the Service; or use the Service to violate any applicable law or regulation, including using it as a tool for market manipulation.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including as to accuracy, availability, timeliness, or completeness of any data or content. To the fullest extent permitted by law, Swoopr Investment will not be liable for any indirect, incidental, or consequential damages, or for any trading losses, arising from your use of the Service, including from inaccurate or delayed data, downtime, model or ranking errors, AI-generated content, or actions taken on a connected third-party platform.

10. Indemnification

You agree to indemnify and hold Swoopr Investment harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any right of a third party, to the extent permitted by applicable law.

11. Force Majeure

Swoopr Investment is not responsible for any failure or delay in the Service caused by events outside its reasonable control, including outages of third-party data, AI, hosting, or trading-platform providers; internet or infrastructure failures; or other circumstances beyond its control.

12. Termination

Access may be suspended or revoked at any time, with or without notice, including for suspected misuse or violation of these Terms. You may stop using the Service at any time.

13. Digital Assets and Regulatory Change

The legal and regulatory treatment of digital assets varies by jurisdiction and may change over time, including in ways that affect an asset's value, legality, or your ability to trade it. Swoopr Investment does not track or guarantee the regulatory status of any asset shown on the Service.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated effective date on this page. Continued use of the Service after a change means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of the United States and the state in which Swoopr Investment operates, without regard to conflict-of-law principles.

16. Related Disclosures

These Terms incorporate by reference the Financial Disclaimer, the Investment & Trading Risk Disclosure, the Data, Rankings & Methodology Disclosure, the Conflicts of Interest Disclosure, and the AI-Assisted Content Disclosure. Read all of them, they're part of the agreement between you and Swoopr Investment, not optional background reading.
